How Military Trials Under the UCMJ Began at Portsmouth Naval Shipyard

Portsmouth Naval Shipyard is located on the border of New Hampshire and Maine and close to the city of Portsmouth, New Hampshire. The location of the base has often led to its confusion with another shipyard located within the actual boundaries of Portsmouth. Portsmouth Naval Shipyard is tasked with repairing and maintaining much of the US Navy’s fleet of Los Angeles Class Nuclear Submarines on the east coast. The Portsmouth Naval Shipyard was established in 1800 by the federal government to deal with aging fleets of merchant and government ships and was in full operation by 1815 (and trials by court martial began then). Throughout the years the shipyard took on additional roles, including housing prisoners of war during the Spanish American War. During World War I and II the Portsmouth Naval Shipyard was in constant activity, repairing battle damaged vessels and building new additions to the fleet. It was during World War II that the Portsmouth Naval Shipyard gained a reputation as a premier facility for the construction and repair of submarines.

The Portsmouth Naval Shipyard Courtroom
Although most Portsmouth Naval Shipyard personnel are civilians today, the small contingent of Sailors are still at risk of court-martial by the mere fact of being on active duty. In addition, service members and retirees who were stationed at Portsmouth Naval Shipyard in the past are still at risk of being court-martialed for alleged crimes during their time there. (For example, service members are currently being court-martialed for alleged crimes in the 1980’s at bases that no longer exist.) Any such court martial would likely take place at a different naval base.
